Program Terms and Conditions:
- All Realtor and Broker participants agree to be bound by the Neatherlin Homes ("Builder") Realtor Referral Program Terms and Conditions and the decisions of the Builder and its administrators whose decisions in all aspects of this Program shall be final and binding. Void where prohibited by law.
- Participating Realtors and Brokers must be licensed real estate professionals in good standing with his/her licensing state(s). Employees of the Builder or its affiliates and members of their household and immediate families who are also licensed real estate professionals are not eligible to participate.
- Real estate professional must personally accompany customer to initial sales office visit and complete the Realtor portion of the Customer Registration Card.
- Customer must execute a Sales Contract for the purchase of a Jim Walter Home or Neatherlin Home or Dream Home within sixty (60) days of the customer's registration for the referral to be commissionable to Broker.
- Commissions will be paid to the Realtor's sponsoring Broker when the home goes under construction as determined by the Builder. No commissions will be paid directly to Realtors.
- In Texas, commissionable sales accumulate from all Jim Walter Homebuilding Group brands Jim Walter Homes, Neatherlin Homes and Dream Homes.
- This is not an exclusive arrangement with a particular Realtor or Broker. It is open to all licensed real estate professionals as described above.
- Participating real estate professionals are required to make all necessary disclosures, whether to the customer, the Builder, or otherwise as required by state laws.
- Real estate professionals are solely responsible for the reporting and payment of any federal, state or local tax liabilities incurred as a result of commissions or promotions paid.
- Realtors and Brokers participating in the Referral Program are neither employees nor independent contractors of the Builder or its affiliates.
- The Builder reserves the right to restrict a real estate professional from registering or participating in the Referral Program and may cancel, suspend, or block the registration of such person if the Builder deems or suspects that the real estate professional has (a) acted in violation of these Terms and Conditions, (b) tampers with or corrupts the registration process or the operation of the Referral Program, (c) loses state licensure to act as a real estate broker, realtor, or agent, (d) conveys anything of value or provides any form of consideration to Jim Walter Homes' sales counselors arising from or relating to participation in the Referral Program, or (d) commits or attempts to commit an act of fraud in the administration of the Referral Program.
- The Builder Realtor Referral Program may be discontinued at any time and is subject to change without notice.
